Music License Agreement
When you purchase Music/Audio Licenses at Senir Design, you’re purchasing a license to use that Music/Audio on a Royalty-Free basis. With Royalty Free License you are free to use the Music/Audio to create an end product without ever having to pay royalties for their use. You are not purchasing the Music/Audio copyright. Senir Design retain the copyrights for delivered Music/Audio and your license to use the Music/Audio is non-transferable, meaning that you are not permitted to sell, rent, give, sub-license, or transfer the Music/Audio to any other party.
Senir Design provide two simple licensing:
1) Standard License
The Standard License grants you, the purchaser, an ongoing, non- exclusive, commercial, worldwide license to make use of the Music/Audio you have selected, on the following terms.
Permitted uses:
- You are licensed to use the Music/Audio to create Single End Product for yourself and/or professional project, or for your employer, or for one client who has asked you to create it, and this license is then transferred from you to your client who must be the final end user of the End Product. (Examples of End Products: apps, audiobooks, CDS, DVDS, corporate videos, games, Indie film & festival, social media, websites, online videos (YouTube, Vimeo, etc.))
- You are licensed to distributed the End Product Free for up to 10,000 copies or downloads, provided the End Product is not “Commercially Distributed”. A Commercially Distributed End Product shall mean the distribution in a physical form or via download of more than 10,000 units of any Single End Product if such End Product is intended to generate revenue to you.
- End Product can be used on Web/Podcast, Indie film & festival, Point-of-Sale & Industrial, most general on-line web uses streaming only purposes. End product can be uploaded to your website, YouTube, Vimeo, etc. with unlimited audience. (Not included on Standard License, Theatrically Released Film, TV & Radio Show, Non-Web & OOH Advertising, TV & Radio Ads, Apps & Games intended for resale)
- Your use of the Music/Audio is limited to a Single seat. (For example: If you use the same Music/Audio for project 1, project 2, and project 3, you have to purchase 3 License)
Not permitted uses:
- You are not permitted to sell, rent, give, sub-license, or transfer the Music/Audio to any other party. Except for one client who has asked you to create it, and this license is then transferred from you to your client who must be the final end user of the Single End Product.
- With Standard license you are not permitted to create End Product, merchandise, templates, or other products for resale or distribution where the primary value of the product is associated with the Music/Audio itself.
- You are not permitted to resell, re-distribute the Music/Audio as stock, even if you modify the Music/Audio in a tool or template, or with source files in any manner that would enable a third party to download the Music/Audio as a separate file.
- You cannot claim ownership or copyright holder of the Music/Audio, whether it’s in original form or of any derivative work created.
2) Extended License
Senir Design Extended License allows you to use the Music/Audio in a Single Project:
Permitted uses:
- You are licensed to use the Music/Audio to create Single End Product for yourself and/or professional project, or for your employer, or for one client who has asked you to create it, and this license is then transferred from you to your client who must be the final end user of the End Product. (Examples of End Products: apps, audiobooks, CDS, DVDS, corporate videos, games, indie film & festival, theatrically released film, social media, websites, online videos (YouTube, Vimeo, etc.)
- End Product can be used on Web/Podcast, Indie film & festival, Point-of-Sale & Industrial, Website, YouTube, Vimeo, etc. with unlimited audience. End Product is permitted for Theatrically Released Film, TV & Radio Show, Non-Web & OOH Advertising, TV & Radio Ads, Apps & Games intended for resale, unlimited copies, or downloads, software’s and applications where the Music/Audio lends primary value to the product. (Example: You can create a Single End Product game app, you can then Sell and make any number of copies or downloads of the Single End Product.)
- This license is a “Single application” license and not a “multi-use” license, which means that you can not use the same Music/Audio to create more than one unique End Product. (For example: If you use the same Music/Audio for project 1, project 2, and project 3, you have to purchase 3 License)
Limitations of Use:
- You are not permitted to sell, rent, give, sub-license, or transfer the Music/Audio to any other party. Except for one client who has asked you to create it, and this license is then transferred from you to your client who must be the final end user of the Single End Product.
- You are not permitted resell the Music/Audio by itself or as part of a package except solely as embodied within your Project.
- You are not permitted to resell, re-distribute the Music/Audio as stock, in a tool or template, or with source files in any manner that would enable a third party to download the Music/Audio as a separate file.
- You cannot claim ownership or copyright holder of the Music/Audio, whether it’s in original form or of any derivative work created.
